MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Lisa Jacobs Conti and Christopher Conti <br /> 45 Popponesset Island Road, Map 106, Parcel 14 <br /> Mashpee, MA 02649 <br /> FINDING-2024-46 <br /> SPECIFIC FINDINGS <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday,August 28, 2024 the <br /> Zoning Board of Appeals voted unanimously to issue a Written Finding to Owners, Lisa Jacobs <br /> Conti and Christopher Conti under §174-17 and §174-33 of the Zoning Bylaws to allow for <br /> construction of a 252 sq.ft.addition to a pre-existing,nonconforming structure on property located <br /> in an R-3 Zoning District, Map 106, Parcel, 14, Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. Site Plan—Prepared for: Lisa&Christopher Conti,Mashpee,MA.Plan Date:July 8,2024, <br /> Plan Scale: 1"= 10',Prepared by Falmouth Engineering. Stamped and signed by: Michael <br /> J.Borselli, Civil No.: 35054, and Gary S. Labrie,No.:40039, Dated: 7/10/24. <br /> 3. Additions &Renovation Plans—Conti Residence, 45 Popponesset Island Road, Mashpee, <br /> MA. Date: July 16, 2024, A-1: First Floor Plan, A-2: Second Floor Plan, A-3: Exterior <br /> Elevations. Prepared by: K. Marshall Works Design. <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Board of Health and Conservation Department comments. <br /> 5. Any changes to the plans will require the applicant to return to this Board. <br /> 6. Conditioned that the applicant seek and obtain the Building Department review in reference <br /> to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a building <br /> permit. <br /> 7. The Board finds under §174-17 and §174-33 that the proposed project is not substantially <br /> more detrimental than the pre-existing, nonconforming structure or use to either the Town <br /> or the neighborhood. <br /> 4 <br />
