MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owner, John T. Simoneau, Trustee of the <br /> John T. Simoneau 2009 Trust <br /> 16 Taffrail Way, Map 106, Parcel 4-0 <br /> Mashpee, MA 02649 <br /> FINDING-2024-47 <br /> Mr. Simoneau described the reconstruction inside the dwelling. There is an existing loft area with <br /> a spiral staircase that will be converted to a bedroom with a code compliant staircase, and will <br /> eliminate a first floor bedroom to accommodate that new room,but it will remain a three bedroom <br /> dwelling. The front deck will be extended slightly to enhance the mechanical room, and the rear <br /> deck will be extended slightly. The non-conformity will remain the same. The front setback will <br /> be a slight improvement from 21.2 ft. to 22.6 ft. <br /> GENERAL FINDINGS <br /> The Board of Health comments dated August 27, 2024 were read into the record; "To remain 3 <br /> bedrooms. House already equipped with VA septic. <br /> The Conservation Department comments dated August 27, 2024 were read into the record; <br /> "Resource Area: Buffer to BVW, buffer to coastal bank, &LSCSF. Administrative Approval(AA) <br /> was issued due to the two (2)proposed additions to existing dwelling will be on existing piles and <br /> installation of drywells to control roof runoff with a work limit in place until AA is closed out. " <br /> The Conservation Agent approval letter dated December 14, 2023 was read into the record. <br /> The subject property located at 16 Taffrail Way contains a total of 11,077 sq. ft. of land. <br /> There were no abutters present. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued, although not conforming with the provisions of this chapter.Non-conforming single- <br /> or two-family dwelling structures may be changed, extended or altered if such change, extension <br /> or alteration complies with the dimensional requirements applicable to the lot under current <br /> provisions of§174-31 or,for lots which have been developed pursuant to §174-21,complies with <br /> such requirements as were applicable to initial construction of the dwelling under provisions of <br /> §174-21. <br /> Changes, extensions or alterations of non-conforming single- or two-family dwelling structures <br /> which do not meet the applicable dimensional requirements as set forth above, and changes, <br /> extensions or alterations of all other non-conforming structures, or non-conforming use's, may <br /> not be made unless there is a Written Finding by the Zoning Board of Appeals that such change, <br /> extension or alteration shall: <br /> 2 <br />
