MASHPEE ZONING BOARD OF APPEALS
DECISION FOR ADMINISTRATIVE APPROVAL
RELATED TO THE NEXT SUB-PHASE OF THE PROJECT
AND THE 40B COMPREHENSIVE PERMIT
The Condition in the Comprehensive Permit specifies that there needs to be language on the plan
that is endorsed by the Zoning Board. However, the plan has already been endorsed by the
Planning Board. Mr. Feronti stated that Attorney Peter Freeman believes it is not appropriate to
have a second endorsement on the plan, and said that the Zoning Board can simply accept the
approval of the plan that was endorsed by the Planning Board. Mr. Feronti stated it is an
administrative process that the Zoning Board demonstrates under the Comprehensive Permit.
Upon motion duly made and seconded at the public hearings on Wednesday, September 11,2024,
the Zoning Board of Appeals unanimously approved Mashpee Commons' request to accept and
approve the plan prepared by BSS Design dated September 11,2023 and endorsed by the Planning
Board on October 18, 2023 pursuant to Condition 45 and Condition #34 of the Comprehensive
Permit Decision, Section IV: Decision and Conditions as it relates to the next sub-phase of the
project.
2
