Salenius, Trustee of the Salenius <br /> Realty Trust requesting a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to <br /> raze a pre-existing,nonconforming single-family dwelling and replace it with a new single-family <br /> dwelling on property located in an R5 Zoning District, at 2 Ned Besse Road, Map 21, Parcel 2, <br /> Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on September 6,2024 and September 13, 2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the request for a Special Permit at the Mashpee Town Hall on <br /> Wednesday, October 9, 2024 at which time the following members of the Board of Appeals were <br /> present; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, <br /> Jonathan Furbush,and Scott Goldstein. Chairman Bonvie opened the meeting and heard testimony <br /> from Attorney Christopher Kirrane, and letters submitted by A.M. Wilson Associates, who <br /> represented Ms. Tonya Daniels and Mr. William Daniels at 26 Melissa Avenue. The Chairman <br /> thereafter continued the meeting until January 8, 2025 to allow time for the Board members to <br /> review supplemental information submitted by Attorney Kirrane, and the abutters. <br /> On January 8, 2025, the continued hearing was opened, at which time the following members of <br /> the Board of Appeals were present and acting throughout; Chairman, Ronald Bonvie, Board <br /> Members, Sharon Sangeleer, William A.
