MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Peter W. Salenius and Cheri Salenius, Trustees or their <br /> successors in Trust, under the Salenius Living Trust <br /> 2 Ned Besse Road, Map 21 Parcel 2 <br /> Mashpee, MA 02649 <br /> Mr. Barbara Nichols, an abutter at 23 Melissa Avenue addressed the Board with a brief history of <br /> the neighborhood, and agreed that the road is accessible. <br /> Attorney Kirrane submitted a letter to the Board dated January 3, 2025 for the record. He <br /> presented historical information of the Ned Besse Neighborhood. In summarizing, Ned Besse <br /> Road was created back in 1963, and is not within the layout of the Daniel's property. He also <br /> said that the deed gives his client the right to access Ned Besse Road, and also has the right to <br /> repair and maintain his property.He also stated that the Board approved a raze and replace project <br /> at 24 Melissa Avenue with no issues, and no complaints by the abutting neighbors. <br /> Attorney Kirrane stated that the Ground Water Protection District is under the Special Permit <br /> requirement, and this application does not require a Special Permit under this bylaw. Chairman <br /> Bonvie agreed. <br /> Chairman Bonvie polled the members for questions/comments. There were no more questions. <br /> GENERAL FINDINGS <br /> The subject property located at 2 Ned Besse Road contains a total of 12,800 sq. ft. of land. For <br /> purposes of calculating minimum lot size under §174-31 n. 16, the lot area is 1,398 sq. ft. The <br /> subject lot is located in the R-5 Zoning District and has the following minimum dimensional <br /> requirements: <br /> Minimum lot size- 80,000 square feet <br /> Minimum Frontage— 150 feet <br /> Minimum Front Yard Setback— 15 feet <br /> Minimum Side and Rear Yard Setback— 15 feet <br /> Maximum Lot Coverage—20% <br /> Maximum Height—35 feet (2.5 stories) <br /> The Board of Health comments dated January 6,2025 were read into the record."Septic is designed <br /> for 3 bedroom, and the house would be 3 bedroom. The house is also in Phase 2 of the Sewer. The <br /> existing dwelling is currently three (3) bedrooms, and the Board of Health approved the plan to <br /> remain at three (3) bedrooms. The Board of Health is also allowing the applicant to apply for a <br /> variance for the septic system because the area is included in the Phase 2 of the sewer project, and <br /> does not require an upgrade to an IA system. <br /> 3 <br />
