�. � Town of Mashpee <br /> 16 Great Neck Road North <br /> a <br /> Mashpee, MA 02640 <br /> U,0 <br /> UVO <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2024-52 <br /> Owners, Matthew David Hudson and Doc.:1435765 <br /> Carol Marie Hudson Ctf.: 227117 <br /> 75 Popponesset Island Road <br /> Map 106, Parcel 8 <br /> Mashpee, MA 02649 <br /> A Petition was filed on August 29, 2024 by Owners, Matthew David Hudson and Carol Marie <br /> Hudson requesting a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow <br /> for construction of a stairway to access an existing deck,and add a screened in deck with a screened <br /> in porch below on property located in an R-3 Zoning District, at 75 Popponesset Island Road,Map <br /> 106, Parcel 8, Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on September 6, 2024 and September 13,2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, September <br /> 25, 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Vice Chair, Sharon Sangeleer, and Associate Members, <br /> Charles Reidy,Robert Caggiano, and Michael Milbury. Also present was David Morris, Building <br /> Commissioner. <br /> Attorney Kirrane represented the homeowners who are requesting a Written Finding under §174- <br /> 17 and §174-33 to alter a pre-existing, nonconforming single family residence. Also present was <br /> Mark Dibb with Cape and Islands Engineering. <br /> The proposal includes a stairway access to a first story deck, and a screened in porch on the rear <br /> of the house with a screened in deck above. This lot is located in the R-3 Zoning District which <br /> requires a minimum lot size of 40,000 sq. ft. a minimum frontage of 150 ft., a 40 ft. front yard <br /> setback,and 15 ft. side and rear yard setback,20%lot coverage,and a 50 ft. setback from wetlands. <br /> 1 <br />
