MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Craig Jordan Chaffee and Marybeth Chaffee <br /> 11 Waterline Drive North, Map 120, Parcel 170 <br /> Mashpee, MA 02649 <br /> FINDING-2024-49 <br /> 2. The proposal will be an improvement to the lot and is similar in size and character to <br /> other existing structures in the neighborhood. <br /> 3. The proposed additions, based upon the plans submitted to the Board, will be consistent <br /> with applicable State and To statues, regulations, bylaws and plans, complies with the <br /> dimensional requirements applicable to the lot under current provisions of§174-31 (Land <br /> Space Requirements Table Footnotes) #16 of the Little Neck Bay Subdivision,or for lots <br /> is have been developed pursuant to §174-2 1, complies with such requirements as <br /> were applicable to initial construction of the dwelling under provisions of §174-21 <br /> Nonconforming lots. <br /> 4. Construction of the dwelling is contingent upon Board of Health final approval. <br /> 5. Construction of the dwelling will conform to current building code requirements. <br /> 6. There is adequate land area to provide sufficient parking and setbacks as may be required. <br /> §174-33 — Setback from water and wetlands: Any building or structure, exclusive of fixed or <br /> floating piers, wharves, docks, bridges or boardwalks, shall be set back at least (50') feet from <br /> any water or wetland as defined by MGL C. 131, §40. <br /> SPECIFIC FINDINGS <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday, September 25,2025 <br /> the Zoning Board of Appeals voted unanimously to issue a Written Finding under §174-17 and <br /> §174-33 of the Zoning Bylaws to Owners, Craig Jordan Chaffee and Marybeth Chaffee to allow <br /> for removal of an existing deck to be replaced with a new front porch, and a new second floor <br /> addition to a pre-existing, nonconforming structure on property located in an R-3 and Little Neck <br /> Bay Cluster Subdivision, at 11 Waterline Drive North, Map 120, Parcel 170, Mashpee, MA with <br /> the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. Site Plan—Prepared for: Craig and Marybeth Chaffee, Project: I I Waterline Drive North, <br /> Date: June 5, 2024, Prepared by Cape & Islands Engineering, Stamped and signed by: <br /> Matthew Costa,No: 52282 and Charles Rowland, Civil Engineer,No.: 52699. <br /> 3.
