MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner, Heidi Dalaklis, Trustee of the <br /> Heidi M. Dalaklis 2017 Trust <br /> Map 123,Parcel, 79, Mashpee, MA 02649 <br /> SP-2024-55 <br /> The project was approved by the Conservation Commission, and a new IA system is being <br /> proposed.It will be flood zone and building code compliant.There are dry wells being installed to <br /> prevent any storm water runoff. There are no new nonconformities being created. The proposed <br /> structure will not be substantially more detrimental to the neighborhood. <br /> GENERAL FINDINGS <br /> The subject property located at 26 Pembroke Drive contains a total of 9,000 sq. ft. of land. For <br /> purposes of calculating minimum lot size under §174-31 fn. 16, the lot area is 407 sq. ft. The <br /> subject lot is located within the Popponesset Overlay District. The minimum dimensional <br /> requirements in Popponesset Overlay District are as follows: <br /> Minimum Lot Size—6,000 sq. ft. <br /> Minimum Frontage—60 feet <br /> Minimum Front Yard Setback—25 ft. <br /> Minimum Side and Rear Yard Setbacks— 15 ft. <br /> The abutter letters from 25 Naushon Rd. and 47 Uncatena Rd were read into the record and are in <br /> favor of the project. <br /> The Board of Health Comments dated December 6, 2024 were read into the record; "Septic <br /> Designed for 3 bedroom with L4 technology. House is designed with one bedroom on the first floor <br /> and two (2) on the second. " <br /> The Conservation Department comments dated December 2, 2024 were read into the record; <br /> "Resource Areas:LSCSF, Buffer zone to Coastal Bank, &Buffer zone to BVW-Notice of Intent <br /> application was approved unanimously due to flood zone value enhancement, conversion of lawn <br /> area to native wildflower area, mitigation plantings, and IA septic will enhance resource areas <br /> and buffer zones on the property lot. Three monitoring and maintenance contract with a certified <br /> professional for all mitigation plantings to be submitted.
