M <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Karl F. Oliver and Carol A. Oliver, Trustees of the <br /> 25 Riverside Road Realty Trust <br /> 25 Riverside Road, Map 119, Parcel 82 <br /> Mashpee,MA 02649 <br /> SP-2024-56 <br /> The existing lot coverage is 27.2%, there is 75 ft. frontage, and the southwest side yard setback is <br /> 3.6 ft. and is also nonconforming. The structure and lot coverage will reduce from 27.2%to 25.9% <br /> lot coverage, which is 183 sq. ft. of structure coverage. The northeast side yard setback of 3.6 ft. <br /> is improving to 8 ft. The proposal includes a building code compliant structure, a new IA Septic <br /> System, and there will be drywells installed. This project was approved by the Conservation <br /> Commission, and there are no new nonconformities being created. <br /> SPECIAL PERMIT FINDINGS <br /> The Conservation Department comments dated October 2, 2024 were read into the record. <br /> "Resource Areas: LSCSF and buffer zone to Salt Marsh. NOI application was approved with a <br /> unanimous vote due to reduction in dwelling footprint, L4 septic installation, SWM systems, and <br /> accommodating for future salt marsh creep. Concerns with the delineation of the salt were <br /> addressed with future high tide line marked on the plan of record with the following conditions <br /> applied": <br /> • Three foot wide native planting bed along the ].9-2.0 future high tide line <br /> • Two year mitigation maintenance and monitoring contact with a certified <br /> professional <br /> The Board of Health comments dated October 4, 2024 were read into the record; "Septic is only <br /> upgraded for one building on the facility. INNOVATIVE/ALTERNATIVE ON-SITE SEPTIC <br /> SYSTEMS REGULATION.- IV. APPLICABILITY When an IA Septic System is being installed on <br /> a facility then all systems on the facility shall be connected to the IA Septic System or be upgraded <br /> to an additional IA Septic System. " <br /> The Board had a discussion regarding the Board of Health comments questioning if all the <br /> buildings will be connected to the IA system. The Board will impose a condition, and agreed that <br /> a plan be submitted for a minor modification if a revised plan is necessary. <br /> Attorney Kirrane agreed with the Board and will submit a revised plan with an application for a <br /> minor modification. <br /> The Building Commissioner will require an engineered stamped plan for the foundation depicting <br /> the flood vents to be submitted during the permitting process. <br /> The subject property located at 25 Riverside Road contains a total of 3 5,3 11 square feet of land. <br /> There were no abutters present. <br /> 2 <br />
