i . <br /> December 20, 2022 <br /> Ms. Mary Waygan, Chairwoman <br /> Mashpee Planning Board <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> Re: Spring Hill West Subdivision Modification (Tudor Terrace) <br /> Dear Chairwoman Waygan: <br /> Please allow this letter to address several questions the Planning Board <br /> had regarding the project and the history of the existing Subdivision. <br /> Specifically, I have addressed the conditions of the existing Special Permit, the <br /> status of the existing Way shown on the original subdivision plan, and <br /> compared the zoning provisions applicable to the original permit versus today's <br /> requirements. <br /> SPECIAL PERMIT CONDITIONS <br /> Per the Board's request, I have reviewed the Special Permit conditions for <br /> the Spring Hill West Subdivision, a Cluster Subdivision approved by the <br /> Planning Board in 1989. It must be noted that this applicant was not the <br /> original developer and has only recently developed a small number of the lots <br /> in this subdivision. With that caveat and to the extent I can determine <br /> compliance, based on nay review, I have found the following: <br /> Condition No. 1: <br /> Condition No. 1 required the developer to convey open space parcels and <br /> access easements to the Town of Mashpee. <br /> The applicant cannot affirm whether this condition has been complied with, <br /> but given that building permits and covenant releases were issued the <br /> applicant assumes the original developer complied with this condition. <br /> Massachusetrs 1 (508) <br />
