4 Select Board Minutes February 10, 2025 APPOINTMENTS & HEARINGS Public.Hearin g- A ) or New Annual Wine and Malt Beye Store license,.2.0,North 4,11 licafio,nf,_.__,,._. qs p4ck4gq q Street—Uva Wine BoutW Michelle Manware: (continued) Comment was received from Dennis Murphy, counsel for the Uva Wine Bar/Uva Wine Boutique regarding MGL Chapter 138, §17 enacted in 1937 which in his opinion is an antiquated system of licensing. In support of the new business Mr. Murphy indicated the license is already held by the establishment,thus it should not be counted as a separate license since it is under the same license holder. The Select Board was requested to authorize an off-premise license under this unique circumstance, and not count this to the Town's quota. Discussion followed. There is concern with respect to setting precedent. The Town Manager was directed to consult Town Counsel with respect to this regard for further review at the next meeting. Motion made by Selectman Cotton to continue the Public Hearing on the application of Uva,Wine Boutique,20 North Street,Mashpee for a New Annual Wine & Malt Beverages Package Store License to Monday; February 24,2025. Motion seconded by Selectman O'Hara. VOTE: 4-0. Unanimous. The Select Board opened the Public Hearing on the application filed on November 13, 2024 by Richard J. ,Cook,Jr.,d/b/a Popponesset Oyster Company, LLC, 19 Pem Way, Mashpee for the renewal of Shellfish Grant 4013, Popponesset Bay 1.99 acres. The hearing notice was read into the record. Richard Cook,Jr. was in attendance to review the license request due to expire in January 2025. Chris Avis, Shellfish Constable and Peter Cook, Chair of the Shellfish Commission were in attendance for discussion purposes. Mr.Avis in his memo of January 15, 2025 recommended the renewal of the grant agreement. Mr. Cook is current with all fees required for the grant, and has met all the production values during the I 0-year grant. In accord with regulations,new licenses are granted for a 5-year period only. Being no public comment,the Select Board motioned as follows;
