MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 12, 2025 <br /> Mr. Bonvie took a roll call vote if granting a Variance will not nullify or <br /> substantially derogate from the intent or purpose of the ordinance. The Board is <br /> aware a judge stated that flood plain cannot be used in lot coverage. Mr. Bonvie, <br /> agreed, Mr. Milbury, agreed, Mr. Goldstein, agreed, Mr. Furbush, agreed, and <br /> Ms. Sangeleer, agreed. <br /> Mr. Bonvie stated that the Board has issues with the first two variance items. <br /> There were no more comments. <br /> Attorney Kirrane requested a continuance until March 12, 2025. Mr. Furbush <br /> made a motion to accept the continuance, Ms. Sangeleer, second. All were in <br /> favor. <br /> Sitting on this hearing are four regular Board members, and Associate Member, <br /> Michael Milbury. <br /> 157 Daniels Island Road: Owners, Frank T. and Christina O. Varinos request a <br /> Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze and <br /> replace an existing single family residential structure with a new code compliant <br /> single family residential structure on property located in an R3 Zoning District, <br /> Map 105, Parcel 272, Mashpee, MA. (Continued from January 8, 2025 hearings <br /> at the request of the Attorney). <br /> 157 Daniels Island Road: Owners, Frank T. and Christina O. Varinos requests <br /> a Variance under §174-31 from lot coverage. Existing lot coverage is 17.8% and <br /> the proposed lot coverage is 21.9%. The Owners are requesting to raze and <br /> replace an existing single family residential structure with a new code compliant <br /> single family residential structure on property located in an R3 Zoning District, <br /> Map 105, Parcel 272, Mashpee, MA. (Continued from January 8, 2025 <br /> hearings at the request of the Attorney). <br /> Attorney Christopher Kirrane represented the applicant seeking a Special Permit <br /> to raze and replace their single family home. The lot is partially within the flood <br /> zone and has 12,800 sq. ft. of actual upland lot area with 32,600 sq. ft. of total <br /> lot area. The setback to wetlands is zero sq. ft. The original proposal was an <br /> increase in lot coverage from 17.8% to 21.9% which necessitated a variance. At <br /> the last meeting the Board requested that the lot area be reduced to eliminate <br /> the need for the variance. The revised proposal shows a reduction in the size of <br /> the house, and the lot coverage is at 20% and meets the bylaw. <br /> Attorney Kirrane asked the Board to allow a withdrawal of the variance without <br /> prejudice. Mr. Furbush made a motion to accept the withdrawal. Ms. Sangeleer, <br /> second. All were in favor. <br /> 4 <br />
