MINUTES June 3 , 1993 4 t BOARD OF HEALTH <br /> Mr. Greelisli commented, "Officially we cannot consider <br /> this as a proposal. " "There was a cutoff date and this Board <br /> did agree to accept B.F.I. 's proposal." <br /> Mr. McQuaid relayed, "Under Chapter 34B the "Procurement <br /> Act" excludes any contracts having to do with solid waste <br /> which includes recycling. " <br /> Mr. Ball recommended the Board request Town Counsel's <br /> opinion on the matter. <br /> Mr. Greelish stated, "We should not confuse the issue <br /> and not put the burden on Town Counsel. " "We collectively <br /> made the decision to operate within a particular time frame. " <br /> "We discussed and agreed in an open meeting that we would <br /> have a cut off and that the last person we were waiting for <br /> was Waste Management. " "We agreed to give them time to come <br /> forward and that was it. ,, "We were going to close down any <br /> further considerations. " <br /> Mr. Ball reiterated his earlier comments stating this <br /> Board should request Town Counsel's opinion on the matter. <br /> Mr. Greelish relayed, "Mr. DiMaggio was fully aware that <br /> the Board was soliciting recycling proposals. " "I am unsure <br /> as to whether he was aware he could submit a proposal. " . "I <br /> feel very badly that this has occurred but personally and as <br /> a representative of this Town and this Board I would not rec- <br /> ommend we proceed any further. " "This Board did solicit <br /> hauling companies to submit proposals. " <br /> Mr. McQuaid relayed, "I do recall the Board approving <br /> the contract pending Town Counsel's review. " <br /> Mr. Greelish commented, "B.F.I . may take legal <br /> recourse. " "Mr. DiMaggio was contacted and involved in the <br /> process. " <br /> Mr. Ball motioned to forward the proposal submitted by <br /> S. Joseph DiMaggio and the minutes pertaining to the agree- <br /> ment between the Board and B.F.I. to Town Counsel and request <br /> his opinion as to whether this Board can legally consider <br /> it, Mr. Greelish seconded. Mr. Greelish and Mr. Ball agreed <br /> to request the response via telephone. <br /> Being no further business Mr. Ball motioned to adjourn this <br /> meeting at "� 45 p.m.. , Mr. Greelish seconded, all agreed. <br /> Respectfy submitted, <br /> Veronic4JIardent Adm.
