MINUTES March 31 , 1994 5 BOARD OF HEALTH <br /> Mr. Doherty commented, "At this time we cannot include <br /> the 1995 ban as the restaurant owners have agreed to the fi- <br /> nal draft regulation presented this evening. " <br /> Mr. Heufelder commented, "There are some restaurant own- <br /> ers in Falmouth that are concerned that their patrons may <br /> prefer to dine at Mashpee restaurants if smoking is permit- <br /> ted. " <br /> Mr. Doherty commented, "The quicker the County adopts a <br /> regulation the quicker the towns can adopt it. " <br /> Mr. Doherty stated, "The matter will be continued until <br /> next week's meeting. " <br /> APPOINTMENT: John Slavinsky (Cape & Islands Eng. ) - 29 <br /> Seaview Avenue <br /> Mr. John Slavinsky was in attendance for this scheduled <br /> appointment. <br /> Mr. Slavinsky presented preliminary plans and informed <br /> Board members, "This is an existing four bedroom house. " <br /> "There is a 6' x 8' cesspool servicing the dwelling which may <br /> be sitting in groundwater. " "The basement is, finished off <br /> with a bedroom and there are three bedrooms on the first <br /> floor." "The owner is proposing to eliminate two bedrooms on <br /> the main level and add a second story with two bedrooms <br /> therefore, the number of bedrooms will remain the same. " <br /> "The owner would like to upgrade his system to meet Title V <br /> requirements. " "In order to upgrade the system we will re- <br /> quire an 8' variance from the wetland area. " "This is neces- <br /> sitated as the Conservation Commission is requiring we main- <br /> tain 50' from the top of the embankment. " "We will also <br /> require a sideline variance from the reserve. " "No wells are <br /> located within 150' of the proposed leaching facility. " <br /> Mr. Evans relayed, "on May 10, 1993 a septic evaluation <br /> was performed at which time the system was found to be func- <br /> tioning properly. " <br /> Mr. Doherty informed Mr. Slavinsky, "This Board does not <br /> grant variances from the wetlands regulation. " "I would rec- <br /> ommend the installation of a trench system which would main- <br /> tain 100' from the wetland area." <br /> Mr. Slavinsky agreed to revise plans incorporating Mr. <br /> Doherty's recommendation to install a trench system. <br />
