MINUTES March 5, 1994 5 BOARD OF HEALTH <br /> I <br /> I <br /> Mr. Evans stated, "One of my thoughts was to have a <br /> "Farmer's Market" where once or twice a week vendor's could <br /> set up their stands and sell their produce. " "Part of our <br /> restrictions have been the availability of restrooms which <br /> out in the parking lot there have been none. " "The restau- <br /> rant facilities are for the restaurant." <br /> Mr. Ball questioned Mr. Evans as to how the produce <br /> stand at the "Picnic Box" is handled. <br /> Mr. Evans responded, "It is supposed to be operated by <br /> the owner of the restaurant. " <br /> Mr. Ball relayed, "They lease land." "This is about the <br /> same situation. " <br /> Mr. McQuaid relayed, "There is a difference between the <br /> Picnic Box setting up a produce stand and Dick & Ellie's set- <br /> ting up a produce stand." "I am totally in favor of Mr. <br /> Evans recommendation that we keep the Flea Market free of <br /> food whatsoever, other then what is issued through the res- <br /> taurant and instead encourage Mr. Wiseman, if he want to in- <br /> crease his business, to set up a one day a week Farmer's Mar- <br /> ket." "We could inspect there once a week to ensure food <br /> requirements are being met however, we cannot go there five <br /> days a week. " <br /> Mr. Doherty commented, "Every time we deal with a <br /> temporary/transient type of operation it is looked at much <br /> harder than a permanent setup. " <br /> Ms. Feren commented, "The Restaurant will be open seven <br /> days a week and Mr. Wiseman would like the stand open during <br /> the same time. " <br /> Mr. Ball stated, "I cannot see the difference between <br /> the Picnic Box and the Flea Market, it is the same thing. " <br /> "They have permission to use the sanitary facilities. " <br /> Mr. Feren stated, "Mr. Wiseman will supply water and <br /> electricity. " <br /> Mr. Doherty stated, "I would like to forward a letter to <br />" the Board of Appeals questioning them whether they would con- <br /> sider a seven day per week operation of a produce stand in <br /> violation of the special permit. " "Provided that it does not <br /> violate the provisions of the special permit this Board would <br /> consider issuing a license. " <br /> Mr. McQuaid recommended Mr. Feren schedule a meeting <br /> with the Board of Appeals to amend the special Permit. "This <br /> Board will forward a memo stating no objection. " <br />
