"It turns out now that, according to what I have been <br /> told, the storage area is on the first floor of the garage then a full stairway upstairs to <br /> office space." "If you review our definition of habitable space it is stated quite clearly that <br /> an office is considered habitable space." "Mr. Keyes has stated it is an office." "It is well <br /> detached from the house, approximately 50' or 60'." "Mr. Evans did go out to the site <br /> and meet with the O'Malley-Keyes." "In Mr. Evans opinion it should not be considered <br /> additional living space." "There are enough circumstances surrounding this issue that I <br /> did want to bring it to the Board's attention not just the living space but also the situation <br /> with the cesspool." <br /> Mr. Evans stated, "As it currently is and avit's currently proposed I would not <br /> consider it living space." <br /> Mr. Doherty commented, "Our regulations specifies offices as habitable rooms." <br /> Mr. O'Malley-Keyes stated, "Functionally, it would be impossible to live in the <br /> place." "There is no enclosed walkway or anything of that nature." "It is totally <br /> detached." <br /> Mr. Bali questioned Mr. O'Malley-Keyes as to whether he has any intent to <br /> upgrade his septic in the future. <br /> Mr. O'MaIley-Keyes responded, "It has been functioning fine, we have had no <br /> difficulties." "We had someone check it out several years ago." "We have had no <br /> difficulty with it for the longest time." "It has not needed to be pumped for almost two <br /> years." "The system itself has worked excellent." "When we had it pumped three times in <br /> one year it was during the summer when we had a lot of company." <br /> Mr. O'Malley-Keyes stated, "There is no plumbing in the building at all." "It is <br /> heated by propane." <br /> Mr. McQuaid relayed, "The building inspector brought this to my attention." "He <br /> has other concerns that don't pertain to us." <br /> Mr. Doherty stated, "I would request the owners to upgrade." <br /> Mr. O'Malley-Keyes responded, "We will consider it." <br />
