4 •' <br /> r .. <br /> MINUTES August 3, 1995 4 BOARD OF HE-ALTH <br /> Mr. Cram motioned to grant a variance from the edge of active leaching area to <br /> the wetlands with the following stipulations: The variance relief granted shrill not exceed <br /> 25' and shall be verified by the Conservation Commission Agent, a Bio-clere system shall <br /> be installed with a ultraviolet disinfectant unit and the owner shall retain a company to <br /> provide annual maintenance on the system with a copy of the agreement forwarded to the <br /> Board of Health, Mr. Ball seconded, all agreed. <br /> APPOINTMENT: White Water Estates- Cape& Islands' <br /> Mr. John Slavinsky was in attendance for this Scheduled appointment. <br /> Mr. McQuaid relayed, "The Board of Health did approve the location of the test <br /> wells on the previous plans however, we didn't vote on approving the subdivision because <br /> we were aware of a possible open space issue that the Planning Board had insisted on in <br /> this development and the plans don't show open space." "It is before us again because by <br /> law a definitive plans has to be either approved or rejected by the Planning Board." "The <br /> issue of open space as far as the Board of Health is concerned need not be addressed we <br /> only need to address the layout of the septic systems and wells and approve it pending the <br /> issue of open space being resolved by the Planning Board." <br /> Mr. Slavinsky stated, "I think the issue of open space will be resolved in court." <br /> "The purpose of a definitive plan is you can't take the Plannin; Board to court on <br /> preliminary plans." "Town water is not available to the subdivision." "The leaching <br /> facilities are outside of the zone of protection." <br /> Mr. Doherty stated, "I would like to confirm the zone of protection and the non- <br /> availability of town water." <br /> Mr. Cram motioned to approve preliminary plans with the stipulation the engineer <br /> verities all leaching facilities are outside the "Zone of Protection" and verification that <br /> town water service does not extend to the subdivision, Mr. Ball seconded, all agreed. <br /> F.Y.T. <br /> HAZARDOUS WASTE COLLECTION DAY <br /> ]ter.
