MINUTES February 4, 1999 12 BOARD OF HEALTH <br /> Mr. Ball motioned to approve a 1999 Bakery permit to Ms. Charlene Martinez <br /> d/b/a "The Pastry Chef' pending final inspection by the Health Agent, Mr. <br /> Doherty seconded, all agreed. <br /> *****OLD BUSINESS***** <br /> Transfer Station Operations Contract <br /> Mr. McQuaid stated, "This is merely for your review and I suggest within two <br /> week we get back and nail any specifics down that we want as far as changes go <br /> to the operational requirements of the transfer station, and Weston and Sampson <br /> can then, if you desire, proceed with RFP". <br /> Mr. Ball inquired of Mr. DiMaggio, "Being that you have the contract also, would <br /> you offer some input?" <br /> Mr. DiMaggio noted, "Every piece of equipment that is in the contract has to be <br /> there except for the dozier, and added, if anyone needs any help, call me and I'll <br /> be happy to sit down with them". <br /> Assistant Agent's Step-Salary <br /> Mr. McQuaid stated, "Mr. Whritenour took it upon himself and lowered Ms. <br /> Mayer's step from 4 to 3 which would be the step next to her current salary". "I <br /> don't believe this went before the Selectmen". "I contacted June Daley and Moe <br /> Cooper, union negotiators and they provided me with step tables that show when <br /> Ronnie will be getting increases". "Within two years, she will be making a little <br /> more than-$2 an hour more than what she would be if she stays at Step 3". "We <br /> have the opportunity to go before the Board of Selectmen and fight for her <br /> beginning salary to be at Step 4". That may or may not happen but we will go to <br /> bat for her if she so desires". <br /> Mr. Doherty stated, "It has always been the policy of this Board to appoint and fix <br /> the salary of the Agent and Assistant Agent". "I'm not sure now how all this fits <br /> in with the latest changes of the Agent and Assistant Agent becoming members of <br /> the union and whether collective bargaining supersedes Massachusetts Law,but I <br /> believe collective bargaining tends to be Federal". <br /> Mr. McQuaid responded, "The Board still has the absolute authority to <br /> recommend, appoint and fire the Agent and Assistant Agent, however, since the <br /> union contract law came into effect in the early 94's, you do not have the authority <br /> to set our salaries". The Board of Selectmen does that". <br /> Mr. Ball stated, "I think a memo is sufficient explaining our position to Bob and <br /> to the Selectmen, and if they want to call us we will go". <br />
