,MINUTES May 19, 1999 8 BOARD OF HEALTH <br /> Mr. Cassanelli stated, "Isn't there an ethics problem involved in this? Should you be <br /> talking about this?" <br /> Mr. Doherty responded, "Sure, because you removed my conflict the minute you were <br /> awarded. You removed my conflict." <br /> Mr. Esper stated, "Your other conflict is sitting right in front of you." <br /> Mr. Doherty responded, "Why? What financial interest do I have in it?" <br /> Mr. Esper stated, "If they want to re-bid the contract." <br /> Mr. Doherty stated, "You know something, if you think I have a conflict, there is a <br /> State agency that you are more than welcome to contact." <br /> Mr. Esper responded, "John, we don't want to get in any kind of contest..." <br /> Mr. Doherty stated, "Here's my pleasure and here's the way I'll vote. I'll vote to do <br /> nothing. In the wisdom of the Board of Selectmen, you were awarded the contract to <br /> save this town money. I am not in favor of making any change orders because the <br /> conditions of the transfer station have not changed. I am not in favor..." <br /> Mr. Cassanelli interjected, "We bid this contract as it was stated in the RFP. We <br /> weren't considering saving the town money. We were bidding on your specs." <br /> Mr. Nick DiMaggio stated, "If you are going to make a change in the contract, be it 500 <br /> trailers or zero trailers I could care less. It's a change in what is written in that <br /> contract. Every part that was involved deserves the right to re-bid. You can't just <br /> change your mind. A contract is a contract. If they can't meet it, they can't meet it. If <br /> you are going to offer them a change of any sort, whether it be monetary or you go out <br /> and buy the new trailers, you are going to offer them any kind of a change, you'd <br /> better offer it to everybody who bid on the job in all fairness. That's fair business, <br /> period." <br /> Mr. Cassanelli added, "As the contract goes, and your father had it for years, things <br /> change. Just like these recycling bins that are going in. The town changes, the needs <br /> change and every other thing changes. You can't go by a contract from day one to six <br /> months or four years later. These things happen in business. If there is a need for or <br /> a problem with something, you fix it. And you go on with things." <br /> Mr. Esper added, "We plan on fulfilling our side of the contract through July, through <br /> the renewal date. That's no problem. The contract states two trailers and a back-up. <br /> We have two trailers and a back-up. What is the Board's pleasure when the two <br /> trailers are full and there's no, or the three trailers are full if we have the ability to fill <br /> that third trailer. What is the Board's pleasure?" <br /> Mr. Ball responded, "Close the gate. Especially on a Sunday if Otis is closed.
