(3) by re-designating the present text of Article 4 . 9 as Section 4 . 9 . 1 (4) by adoption of a Section 4 . 9 . 2 as follows : "The Board of Selectmen is authorized to appoint one or more herring wardens an& is authorized, from time to time, to make regulations con- cerning the opening and maintenance of ditches , sluice ways or canals into any pond within the Town not in private possession for the introduction and propagation in such pond or in any part thereof of herring, alewives or other swimming marine food fish, and for the creation of fisheries for the same.
