ARTICLE <br /> To see if the Town will vote to amend the Zoning <br /> By-law by deleting the existing. Section 9 . 3 and its <br /> subsections and adding instead the following: <br /> 9. 3 OPEN SPACE INCENTIVE DEVELOPMENT (OSID) <br /> For the purposes of preserving critical open space <br /> and natural resource areas within the Town of <br /> Mashpee , of promoting an efficient pattern of <br /> land development , and of promoting the health , <br /> safety and general welfare of the inhabitants of <br /> the Town , an Open Space Incentive Development <br /> (OSID) may be allowed by Special Permit from the <br /> Planning Board in any residential district <br /> in accordance with the following procedures and <br /> standards. <br /> 9. 31 SITE ELIGIBILITY AND STANDARDS - An OSID shall <br /> include a parcel or parcels of ,land containing A <br /> total of at least twenty ( 20) acres , of which no developable <br /> parcel may be less than five (5) acres in size <br /> ( land subject to seasonal or periodic flooding or <br /> covered by tidal water , pond, lake , stream or river <br /> or any wetlands as defined by M. G . L . C>apter 131 , <br /> Section 40 not to be included in calculating either <br /> total ) . The developed portion of the OSID shall <br /> have a minimum of two hundred (200 ) feet of frontage <br /> on Route 28, Route 151 , Cotuit Road , Central Road, _ Route 130 . <br /> Ouinaquisset Avenue , Great Neck Road, Great Hay Road, <br /> or Red Brook Road in a location which will allow for a sate <br /> entrance onto such road . The developed portion of an OSID <br /> shall not be located ; n any Primary or Secondary Conservation <br /> --area designated by the Mashpee Open Space <br /> Conservation and Recreation Plan or by the <br /> Conservation Commission . 114o structure within the <br /> developed portion of an OSID may be located and no <br /> clearance of natural vegetation , except as provided <br /> elsewhere in Section 9. 3, may occur within <br /> three hundred (300 :: feet of any fresh or salt water <br /> body of more than ten ( 10) acres or i,ai th i n three <br /> hundred <300) feet of the Mashpee , Santuit , Ouashnet <br /> or Childs Fivers or Red Brook or their .adjacent wetlands or <br /> within one hundred ( 1 00) -feet of an/ active or recently <br /> active (within 10 years) cranberry boy or any wetlands as <br /> defined by M. G.L. Chapter 131 , Section 40 or any arterial <br /> street noted above . The provisions of this section <br /> regarding building setbacks or clearance oT <br /> vegetation shall not .apply to any artificial water- body or- <br /> ur.3.tercourse created as an entirety new water body, <br /> not b::- dredging or err 1 ar gemen t c� ��� i st i ng water body <br /> or watercourse ) .as part of the OSID in conformance with <br /> arry applicable local , state or federal regulations.
