The Moderator read Article 25 Article 25. To see if the town will vote to amend Section 4 . 7. 5 of the Town By-Laws by replacing subsection d. with the following: 10d. All water skiing is subject to the applicable provisions of the General Laws of the Commonwealth, as amended, and to the further restriction thAt- nn water skiing, jet skiing, motor or propelled surfboards or water bikes, are to be operated in or on the fresh and salt waterways of Mashpee before the hour of 10 :00 a.m and after the hour of 6 :00 P.M. " , or take any action relating thereto. Donald Lund: I am a member of the Waterways Commission and a Waterways Special Poli7e officer. I move this Article as printed excepting the phrasevor take any action relating thereto." Motion seconded. Voter: Why? Mr Lund: We have given the best hours to the water skier . This is the feeling of the Waterways Commission. We also feel that the fellow who wants to fish at night has some rights. Ahalf hour before sunset is almost impossible to enforce; everybodys' watch is different and it naturally changes everyday. We feel everybody has their rights including the person who wants to sit on their porch and have a little peace And quiet. Voter: O''ir, I work from 8 to 6. Mr Lund: That is why it is seven days a week Voter; I, also work from 8 A.M. to P.M. I feel this is going to cut down on my enjoyment . I just bought a house on Xashpee Lake for the purpose of water-skiing. I water-ski in November and in April and it is dark at 6P.M. . . I think a half hour before sunset is better. Mr Benway: In Popponesset Bay and aquoit Bay; Will we share joint Jurisdi,otion ? If' this passes, how do you propose to enforce such a bylaw? Mr Lund: It will be a problem but at least we can enforce it. . .we can not enforce it at all now. The biggest offenders are Waquoit Blay and especially Popponesset. We are a non -paid 3oard and we are trying to do the best for Mashpee. This is a big safety reason for them. It gets later and the people do not listen; somebody could get hurt. I am sorry that there will be some hurt in that they can not get in as much skiing as possible but we have to do our best. Mrs Muse: I do not water ski, jet ski of surf; but I think this is too MrT Mr Benway: I would like to step down as Moderator and make a statement, also. I know a lot of 16. . . 17 year olds who ski and they work in rest- aurants all summer long and get home around five or six. When they do go out to ski after six, its the time the blathers are not out there. There is not the conflict at these hours as during the day. I think that '15o say to a kid wether he is a tourist renting or if he lives here that you can not ski legally on any waterway between six and eight o' clock is just not justice. How are we going to decide who is in the middle of Popponesst or 'aquoit Bay? I think we are creating an awful bag of worms and it is going to be an awful job for Mr Lund and his group. Mr Lund: How do we do it at `�,Ien in the morning? How about the man who fishes'?
