o Applicant clarified minimal wave action and extensive buffer mitigating impacts <br /> Fill Concerns: <br />o Commission expressed discomfort with 1,100 cubic yards of fill and its proximity <br />to the 75ft buffer <br />o Applicant explained the fill usage for grading to prevent erosion and allow future <br />access <br /> Mitigation Opportunity: <br />o Applicant suggested off-site mitigation on the neighboring lot at 129 Daniels <br />Island Road, which includes overgrown tennis courts suitable for restoration and <br />native planting <br />Public Comment: <br /> None <br />Agent Comments: <br /> Emphasis is placed on the subject lot being undeveloped <br /> The rationale for the waiver removals is discussed <br /> Recommendation: a continuance to allow for the applicant to update the project proposal <br />to include the mitigation of 129 Daniels Island Road <br />Motion: <br /> Ms. Thornbrugh makes a motion to deny the project without prejudice. Ms. Godfrey <br />Seconds the motion. <br />Further Discussion: <br /> Commissioners discussed the reasoning for the proposed denial. <br />o Under Regulation 25-2-A <br /> Off-site mitigation exploration: restoring 14,367 sqft of overgrown tennis courts at 129 <br />Daniels Island Road as potential mitigation. <br /> Zoning Department Involvement: Review fill requirements and compliance with zoning <br />regulations post-hearing <br />Roll Call: <br /> Ms. Thornbrugh (Yes), Mr. Cook (No), Ms. Godfrey (Yes), Ms. Zollo (Yes), and Mr. <br />Colombo (Yes). <br />o Motion passes (4:1) <br /> <br /> BOARD OF HEALTH: These two (2) abutting lots are held in common ownership and <br />are considered one (1) “facility.” Lots have a combined land area of approximately <br />80,000 square feet. New construction triggers the need for full compliance with BOH I/A <br />Septic Systems Regulation (Rev: 1/7/24). I/A septic design plan to be reviewed upon <br />submission to BOH.
