2 <br /> Board of Selectmen <br /> Minutes <br /> March 17, 2008 <br /> Present: Selectman Cook, Selectman Cahalane, Selectman Myers, <br /> Selectman Green, Selectman Taylor <br /> Town Manager Joyce Mason <br /> Meeting Called to Order by Chairman Cook at 6: 30 p.m. <br /> Town Hall, Conference Room#1 <br /> APPOINTMENTS AND HEARINGS: <br /> Public Hearing: <br /> Charles Gasior read aloud a memo regarding May Town Meeting Warrant <br /> Article 20; a petition article to rescind Article 21 approved by 415ths vote <br /> at the May 2007 Town Meeting. <br /> Mr. Gasior referenced a letter from the attorney who worked with the <br /> Charter Commission during the drafting of the Home Rule Charter, and <br /> who assisted in the drafting,of Article 21. <br /> As stated in Attorney Curran's letter of January 17, 2008 to the Board of <br /> Selectmen; <br /> The proposed amendments in Article 21 do not `establish'nor do they <br /> incorporate the Water District into the town's executive branch. Nothing <br /> could be further from the truth. There is no basis in the text of the <br /> amendment proposed to...support the conclusion which is stated in each of <br /> the opinion letters you have received concerning this matter. Quite the <br /> contrary, the proposed charter amendment...recognizes the Water <br /> Commissioners are not "town officers", but recognizes them to be <br /> 'officers or representatives of regional authorities or districts. ' <br /> Mr. Gasior indicated the outcome of the Charter amendment proposed in <br /> Article 21 can only be determined by the voters on May I Oh and therefore <br /> this article should be defeated. <br />
