BOX 226 <br /> BARNSTABLE, MA 02630 is 1 0 2007 <br /> ASS CH'Jb (508)362-3828 <br /> FAX (508)362-3136 <br /> E-mail frontdesk@capecodcommission.org <br /> MEETING NOTICE <br /> CAPE COD COMMISSION <br /> Project Name: Cape Wind Energy Project <br /> Project Applicant: Cape Wind Associates, LLC <br /> Project Location: Nantucket Sound and various rights-of-way within Yarmouth and <br /> Barnstable, MA. <br /> Project Description; Proposed offshore wind energy project consisting of the installation and <br /> operation of 130 Wind Turbine Generators and associated infrastructure on <br /> Horseshoe Shoal in Nantucket Sound and installation of a submarine and <br /> overland cable within the towns of Yarmouth and Barnstable. <br /> The Cape Cod Commission will hold a meeting at 1:30 pm on Thursday, May 17, 2007 at the <br /> Barnstable Town Hall Hearing Room, 2" Floor, 367 Main Street, Hyannis MA 02601 for the <br /> purpose of receiving comment from interested parties as to the Commission's jurisdiction and <br /> scope of review over the proposed Cape Wind project in Nantucket Sound.The Commission will <br /> accept testimony on the following questions: <br /> 1. Which Regional Policy Plan (RPP) governs the Commission's review of the Development <br /> of Regional Impact(DRI) process for the proposed Cape Wind project, the 1996 RPP or <br /> the 2002 RPP? <br /> 2. Is the DRI application pending before the Commission complete? Specifically, the DRI <br /> application requires the proof of ownership/legal right to proceed with the proposed . <br /> development. ,Should the applicant be required to possess some or all of the following <br /> before the application,is deemed complete; 1) a grant from the Department of Interior, <br /> Minerals Management Service of a right to occupy the federal seabed, whether by lease, <br /> easement, license or otherwise; 2) a Chapter 91 License from the Massachusetts Department <br /> of Environmental Protection to place its cable on the seabed belonging to the state; 3) a filed <br /> application for a street opening permit within the towns of Barnstable and Yarmouth and/or <br /> other forms of grants from private landowners of rights to place its cable on such property. <br /> 3. Which of the following defines the scope of the Commission's jurisdiction on the project; <br /> 1) review of only those elements of the project on land and within the 3-mile limit, and their <br /> impacts; 2) review of the entire project and its impacts; 3) review of those elements of the <br /> project on land and within the 3-mile limit, in light of the impacts (both positive and <br /> negative) within Barnstable County of the entire project? <br /> The Commission will not deliberate on the merits of the project at this meeting. The Commission's <br /> determination on these three questions will be rendered at a future meeting. Written comments for <br /> the Cape Cod Commission's consideration should be submitted at the meeting, or delivered or <br /> mailed to the Cape Cod Commission, P.Q. Box 226, 3225 Main Street, Barnstable, MA 02630. A <br /> time limit may be established by the Commission for oral testimony at the meeting, but it'should-be <br /> noted that written testimony is given equal weight as oral testimony.
