Mr.. Daneski said the Board should focus on the issues they first had when <br /> the plan was denied. He will write the decision .. <br /> Tang said the date on the plan is 198 . This new one w1, 11 replace that <br /> original plan , and will assume that date and therefore not have to go <br /> before the Cape Cod Commission? <br /> Yes. One sheet is dated Oct 1994 as a revision date.. <br /> Pat he feels it is still a cul de sac and there is no merit to waiving the <br /> overall length . There is so much asphalt he's not sure he would' want to <br /> see it built. <br /> Tony said from what he's seen it is hard to say the bolevard doesn ' t <br /> overcome the safety issues for that portion of road but the 300 feet <br /> negates .any benefit. <br /> Pat thiinks there are other than .dust safety issues for the 800 ft <br /> regulation . <br /> Mr. Daneski said he disagrees with their consultant . The real basis for it <br /> is the ability to get emergency vehicles in and out. <br /> Charlie said if the concern is about something blocking the road, clear cut, <br /> on either side of the road , so trees can never fall in the road. <br /> Tony said this subdivision will never be built. The broader issue is where <br /> this goes for the neat 5 years . <br /> r. Daneski said you know the taking is a fact but you ,should try to ignore <br /> it. Look at it from purely a planning perspective. <br /> Pat said it is poor planning practice to have 800 foot :cul de sacs , Cross <br /> connections are advisable for safety issues and trip reductions, keeping <br /> people off wain arteries. <br /> Mr. Daneski said safety is the main reason upon which they have been upheld <br /> by the courts. It would be much tougher to argue from only a planning <br /> perspective. You shouldn ' t go beyond the reasons origl1nally articulated <br /> ( in the denial ) . <br /> Pat asked if there are time constraints' Mr. Daneski said you don' t want to <br /> let it sit for a long time, _2 more meetings seems reasonable . <br /> The Board discussed the timeline. <br /> Mr. Daneski said if you deny the plan , the concerns over the public notice <br /> are much less. <br /> Tom asked, since Richard Martini did not participate in tonight's <br /> discussion , can he participate in the future? <br /> r. Daneski said he could because this is not a formal public hearing . <br /> Tony said if the Board approves this, someone else could appeal it. If it <br /> is denied , then the applicant can appeal it? Mr. Daneski agreed and said <br /> it will then go bask to the land court. If someone else appeals it, then <br /> the burden of defending it is the applicants . <br /> Tom asked if the Water District has any standing to appeal , as the owners <br /> of the property? <br />
