,y <br /> TOWN OF MASHPEE <br /> OFFICE OF SELECTMEN <br /> TO : Board of Selectmen; Finance Committee; Town Accountant <br /> and Town Clerk <br /> FROM : Executive Secretary, Joseph F. y . <br /> DATE : May 17 , 1989 <br /> RE : Contingent Appropriations <br /> All addressees have received a notice from the division of <br /> local services of the Department of Revenue on the subject of <br /> contingent appropriations . <br /> We have been advised that in the opinion of the division, the <br /> existing law does not permit municipalities to appropriate <br /> money contingent upon the subsequent passage of a Proposition <br /> 2 1/2 override or exclusion vote . <br /> What the division failed to say is that it cannot find <br /> anything in the law prohibiting -- or allowing -- this <br /> mechanism . The Division recommends the Town, instead, <br /> approve the spending, then schedule a referendum . If the <br /> referendum fails , another town meeting would be scheduled to <br /> rescind the prior appropriation. If that attempt to rescind <br /> the appropriation failed, another town meeting would be <br /> necessary to reduce the level of appropriation from another <br /> area .
