Director indicated that the repair could not wait for the "donor" <br /> account to be funded. <br /> Town Counsel expressed concern that because this work would be done <br /> outside of normal protocols that the Town may be liable above the <br /> statutory $5,000 liability cap and the Town' s liability insurance may <br /> not provide coverage. He suggested that the Town contact our insurance <br /> company and have the specific project insured. Chairman Vaccaro asked <br /> Mr. White if his group would reimburse the Town for the additional <br /> insurance expense and all other costs associated with the project . <br /> Mr. White was in agreement. <br /> It was agreed that the "donor" account would re-imburse the Finance <br /> Committee Reserve account for any expenditures and if that was not <br /> possible other avenues would be utilized to restore these funds to the <br /> Reserve Account (i .e. a transfer from revenue available at the Special <br /> Town Meeting on December 17, 1990) . <br /> The Committee was polled for comments. Tony Gallo indicated he was <br /> reluctant to approve the transfer but would because of the gravity of <br /> the situation and the resultant effect on the public health and safety <br /> of the residents of Popponessett island. His sentiments were echoed <br /> by members Heller, Dunivan and Chairman Vaccaro. Members Greelish and <br /> Polka expressed reservations about the Town becoming involved in the <br /> repair. <br /> Carole Dunivan moved approval of a transfer of up to $20,000 to the <br /> DPW repair account. Carl Heller seconded the motion . The motion <br /> carried 4 to 1 , with one abstention. Members Gallo, Heller, Dunivan <br /> and Chairman Vaccaro voted in the affirmative; member Polka voted in <br /> the negative; and, member Greelish abstained . <br /> The meeting adjourned at 7 :40 PM. <br /> 2 <br />
