3 <br /> Board of Selectmen <br /> Minutes <br /> August 22, 2000 <br /> APPOINTMENTS AND HEARINGS: <br /> Robert Sherman—Agreement with the Air Force: <br /> 1 Robert Sherman, Conservation Agent discussed the pending Agreement <br /> with the Air.Force for the EDB treatment at the Quashnet Bogs with <br /> members of the Board of Selectmen_ In the agreement as reflected under <br /> Attachment A, AFCEE would contribute $178,500 for the maintenance <br /> and construction of cranberry bog loading areas and restoration of <br /> irrigation sump pump areas. It was noted that the Agreement has been <br /> reviewed and approved by Town Counsel to form. <br /> Motion made by Selectman Marsters to approve the Agreement for <br /> Services between the United States Air Force and the Town of <br /> Mashpee Conservation Commission as reflected under Attachment A. <br /> Motion seconded.by Selectman Green. <br /> VOTE: Unanimous. 5-0. <br /> Town Meeting Warrant Review: <br /> Robert Sherman Article 926: <br /> Selectman Marsters stepped down for the above referenced discussion. <br /> Article 926,a bylaw provision to adopt Waivers of Requirements was <br /> considered. The bylaw revision would allow flexibility to waive the <br /> specifics of a regulation without undue delay for the re-writing and <br /> promulgation of a revised regulation and would only be invoked when rare <br /> and unusual circumstances are involved. <br /> Section 2 -a. of the bylaw proposal was reviewed. In particular,the failure <br /> of the applicant to provide the Commission with Any information which <br /> the Commission may request in writing and/or at a public hearing...shall <br /> result in the denial of a request for a waiver pursuant to this subsection. <br /> After discussion,the Conservation Agent agreed to insert existing <br /> language in the by]aw pertinent to this subsection. <br /> Section D. of the bylaw proposal was reviewed. Mr. Sherman noted that <br /> the burden of proof is on the applicant, and that it is standard language. <br />
