Mashpee Planning Board <br /> Wednesday, October 4, 1995 <br /> EXECUTIVE SESSION MINUTES <br /> After a roll call vote, the Planning Beard went into Executive <br /> Session at 8:29 p. m. <br /> Present : Chairman Anthony Ferragamo, Patrick, Coffey, Spyro <br /> Miticikcistas, Dennis Balzarini, Martine Mei.jering. <br /> Also present : F. Thomas Fudala, Town Planner ; Eric Smith, <br /> Assistant Town Planner; John Kuchinsk:y, Associate Member . <br /> Chairman Ferragamo stated he's not sure the Board can deny <br /> subdividing open space. He felt an appli-_aant may be able to <br /> subdivision approval , but once they start to build the read, then <br /> they' re destroying open space. Chairman Ferragamo said he' s not <br /> sure there' s any bylaw or statute prohibiting subdivision of open <br /> space, and felt the Board should be clear on why they' re not <br /> endorsing it. Mr. Fudala was concerned that Town Counsel 's <br /> opinion may have fluctuated over time regarding this. The Board <br /> discussed this further, and suggestion was made to ash; Mr . <br /> Sullivan to withdraw his plan. <br /> Chairman Ferragamo instructed Mr . Fudala to relay t�� Town <br /> Counsel : 1) if the Board is going -to deny the plan, is it <br /> preferable to Town Counsel that they deny it based on Town <br /> Counsel ' s motion in her memc, cif September ICE; 2) make Town <br /> Counsel aware ��f the other factors involved - the front yard <br /> setback. and Great Hay Rd. issues; 3) ask: her to write the motion; <br /> 4) ask: her if there' s anything that states You can' t subdivide <br /> .pen space. <br /> On a MOTION by Mr . Coffey and SECONDED by Mr . Balzarini <br /> it was unanimously voted by roll l call vote ��f Mr . <br /> Coffey, Mr . Balzarini , Mr . Ferragamo, Mr .
