The Town of Mas:'ipee, those of its Officials <br /> that are concerned, and to whoa, else it may <br /> Concern: <br /> August 4, 1983 <br /> As your records disclose, I am the owner of certain land <br /> that is situated abutting Turtle Back Road, at or near the <br /> junction of Route 28 and Old Mill Road in Niashpee. <br /> As you know, or should grow, the Land Court for this Com- <br /> monwealth entered a Decision on March 4, 1974, invalidating (on <br /> Constitutional Grounds) the Zoning Amendment that was adopted <br /> by a Special Town Meeting held on August 4, 1971, as it applied <br /> to my land, thereby reinstating the Zoning to "Business" or, if <br /> you will "Commercial". <br /> As far as I am able to determine, all of your Town records, <br /> except for your Assessing Department, but including your recent <br /> Zoning Maps and Town Clerk' s office, seem to show my land as <br /> "Residential", notwithstanding the aforementioned Decision from <br /> a Court of Competent Jurisdiction. To consider this a mere <br /> oversight is beyond my compre:lension. ' <br /> Unless there is forthw_i .h compliance wyt.h the Land Court <br /> Decision, I shall take that action I consider necessary to pro- <br /> tect my rights and property. <br /> i do bring to your attention the provisions of the United <br /> States Civil.
