ing the principle dwelling unit on the same lot but it shall <br /> include each individual room or suite of rooms in any hotel <br /> or motel. <br /> I <br /> G. Administration <br /> ' 1. Board of Appeals—A Board of Appeals shall be ap- <br /> pointed by the Selectmen. The Board shall consist of three <br /> members and each shall be appointed by the Selectmen to <br /> hold office for the term of three years or until his successor <br /> is appointed and qualified. In case of vacancy, inability to <br /> act, or interest on the part of a member of the Board, the <br /> Chairman -of the Board of Appeals may designate an associ- <br /> ate member pro tem to act in his place. Three associate <br /> members shall also be appointed by the Selectmen, to hold <br /> office under the same conditions as regular members. <br /> 2. The Board of Appeals may in appropriate cases and <br /> subject to appropriate conditions and safeguards make ex- k. <br /> ceptions to the terms of the zoning by-laws in harmony <br /> with their general purpose and intent. <br /> 3. Special permits. <br /> (a) Under all sections of the zoning by-law where the it <br /> granting of special permits is specified, a petition shall be <br /> filed with the Board of Appeals. <br /> (b) A decision of the Board of Appeals on a petition for <br /> special permits shall be by a majority vote of the Board and j <br /> shall be based on consideration of the following factors: <br /> (1) Whether or not the petition falls within the category <br /> specifically excepted by the by-law. <br /> (2) An evaluation of .all the evidence presented at the . <br /> hearing by the petitioner and interested parties as <br /> it relates .to the fulfillment of the spirit and intent <br /> of the. by-law without substantial detriment to the <br /> public good. ' <br /> (c) A special permit shall become void if not made use <br /> of in the intended manner within twelve (12) months. <br /> C• Enforcement <br /> (a) The Chief of Police, upon application of the inspec- <br /> tor of Buildings or a member of the Board of Selectmen shall <br /> cause complaint to be made before the proper court for any <br /> violation under this by-law. Anyone convicted of a violation <br /> under this by-law shall be fined not more than twenty ($20) <br /> dollars. <br /> (b) The Board of Selectmen, upon application of the <br /> Inspector of Buildings shall institute proceedings to enforce <br /> this by-law and to enjoin the construction, alteration, en- <br /> 18 <br /> �t <br />
