If any of the unregistered land is subse- <br /> quently registered and effectively subjected to the foregoing <br /> j.I restrictions in favor of the dominant tenement, it shall there- <br /> after be treated, for all purposes of this Section F, as if it <br /> had been registered and subjected at the time of approval <br /> t of the plan. <br /> (2) For the purposes of this Section F. V., a "dwelling <br /> unit" shall not include detached buildings on any lot utilized <br /> solely for non-payingp py-y guests of the person or persons occupy- <br /> ing,( ing the principle dwelling unit on the same lot but it shall <br /> x' j include each individual room or suite of rooms in any hotel <br /> r <br /> or motel. <br /> I ' 111 G. ADMINISTRATION <br /> 1. Board of Appeals—A Board of Appeals shall be ap- <br /> $ pointed by the Selectmen. The Board shall consist of three <br /> members and each shall be appointed by the Selectmen to <br /> hold office for the term of three years or until his successor <br /> is appointed and qualified. In case of vacancy, inability to <br /> act, or interest on the part of a member of the Board, the <br /> t Chairman of the Board of Appeals may designate an associ- <br /> ist <br /> k� ate member pro-tem to act in his place. Three associate <br /> g I? members shall also be appointed by the Selectmen, to hold <br /> 1, office under the same conditions as regular members. <br /> 2. The Board of Appeals may in appropriate cases and <br /> subject to appropriate conditions and safeguards make ex- <br /> ceptions to the terms -of the zoning by-laws in harmony with <br /> their general purpose and intent. <br /> ! 3. Special permits. <br /> ` (a) Under all sections of the zoning by-law where the <br /> granting of special permits is specified, a petition <br /> shall be filed with the Board of Appeals. <br /> ( (b) A decision of the Board of Appeals on a petition for <br /> special permits shall be by a majority vote of the <br /> Board and shall be based on consideration of the <br /> I• following factors: <br /> I <br /> (1) Whether or not the petition falls within the cate- <br /> gory specifically excepted by the by-law. <br /> ! (2) An evaluation of all the evidence presented at the <br /> L' hearing by the petitioner and interested parties as <br /> it relates to the fulfillment of the spirit and intent <br /> of the byAaw without substantial detriment to the <br /> public good. <br /> (c) A special permit shall become void if not made use <br /> of in the intended manner within twelve (12) <br /> months. <br /> 10 <br /> � p <br /> }n; <br /> f� <br />
