VII m,y
8
then not be interested in it.
Tony does not think there is money to be made from that property with all
the infrastructure that is needed. Dr. McDonald is good at innuendos, etc.
However, what is the effect to the Town? What is the effect to all the
property that may be bought by the Wildlife refuge? Do they all get 5 year
permits? In his opinion they do. It has to be even handed.
Tom said most subdivisions do get 8 years protection but this is a special
permit cluster.
Tony said if they do agree to give him 5 years, it should be stipulated
that he doesn't d any work until the start of the 4th year or as long as
the Town is actively pursuing the Wildlife Refuge.
Tom said that would give them more of a window of opportunity. There won't
be any funding until next year and that is for the highest priority
properties. There are higher priorities than this property.
Tony asked George if this is the opinion of the Board of Selectmen?
He said it is not, this is his own opinion .
George said the Board of Selectmen would probably do whatever the Planning
Board wants them to do. They would probably ask the property get on the
priority list. The Town would then own the whole pond, the only
undeveloped pond in Town.
Pat said, with an approved, permitted subdivision, the property is worth
more in any taking. Is it more likely to be bought if it is worth less?
Tony suggested letting the Federal agencies know that a timeclock is
ticking . If they want the property, they better buy it now or it will be
built on.
George will try to get this property on the list right away.
If Dr. McDonald puts the roads in, Fish and Wildlife won't even put it on
the list.
Tony suggested the Board talk with Town Counsel about conditioning the
extension. Maybe give a 2 year special permit with 3, 1 year extensions.
George suggested conditioning it so if someone else buys the property, the
clock starts running, to try to keep Dr. McDonald from selling it.
Tony suggested the extension go with it, let it be transferred, so no other
owner begins development either.
Dennis said the 5 year extension will make the property worth more , in
theory, it's value will only rise.
George said he is not trying to help Dr. McDonald in any way, he is just
hoping to get that property for the Refuge .
Tony said he would like something, a memo, from the Board of Selectmen
saying they feel this is in the best interest of the community . He wants
to go into this together - the Town Planner, Board of Selectmen and the
Planning Board - all agree it is in the best interest of the community.
The Board authorized Tom to work with Town Counsel and ask him to draft up
this proposed settlement. Try to get a response from McDonald and his
attorney Oppenheim.
9
