MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 23, 2025 <br /> 119 Daniels Island Road: New Seabury Homes, LLC request a Variance under <br /> §174-33 of the Zoning Bylaws, and MGL Ch. 131 §40. Proposed construction of <br /> a single-family dwelling and associated site work shall be setback at least fifty <br /> (50) feet from any water or wetland on property located in an R-3 and within the <br /> New Seabury Special Permit District (1964), Map 105, Parcels 285 8v 286, <br /> Mashpee, MA. (Continued from 3126125, and 4123125 hearings at the request of <br /> the Attorney). <br /> Mr. Caggiano read the public hearing notice into the record. Mr. Milbury read a letter <br /> submitted by Attorney Rob Mills requesting a continuance until May 14, 2025. <br /> Mr. Reidy made a motion that the Board accept the continuance until Wednesday, <br /> May 14, 2025. Mr. Ganzenmuller second. All were in favor. <br /> 9 Santuit Lane : Owner, R Investments, LLC requests a Special Permit under <br /> §174-17.1 of the Zoning Bylaws to raze a pre-existing, nonconforming single- <br /> family residential structure and replace it with a new single-family residential <br /> structure and garage on property located in an R-5 Zoning District, Map 30, <br /> Parcel 15, Mashpee, MA. (Continued from March 12, 2025 at the request of the <br /> Attorney). <br /> Sitting on this hearing are Ms. Sangeleer, Mr. Goldstein, Mr. Furbush, Mr. Caggiano, <br /> and Mr. Ganzenmuller. <br /> Attorney Brian Wall presented. Also present was Mr. Mike Borselli with Falmouth <br /> Engineering. <br /> The project consists of razing and replacing the existing dwelling. The existing house <br /> is situated too close to the pond. The proposed house will be reconstructed further <br /> away from the pond. It will comply with front, rear and side yard setbacks. The lot <br /> coverage will slightly increase but it will comply with lot coverage. It has been <br /> approved by the Conservation Commission, and Board of Health. <br /> At the last meeting there were two issues with both the site plan and house plans. <br /> Mr. Goldstein noted that there was an inconsistency with the house plans. The site <br /> plan showed the deck extending the entire length of the rear of the house, and the <br /> house plans did not show the same. The other issue was that Mr. Morris said that <br /> the septic system in the front of the property had to be raised because of the water <br /> table and the retaining wall that surrounds it. The width of wall was deemed to be a <br /> structure and was too close to the lot line. The plan was revised to show the re- <br /> design of the wall. Instead of using concrete blocks that were 2 ft. thick, there will <br /> be a poured concrete wall constructed 8 inches thick, and will be under 100 sq. ft. <br /> and moved 5 ft. away from the lot line. <br /> 6 <br />
