<br />      			Monomoscoy under §174.17.1 of the Zoning Bylaws to raze and replace a three (3)
<br />      			bedroom non-conforming residential structure including a pool on property located in an
<br />      			R-3 Zoning District,Map 124 Parcel 49,Mashpee, MA,with the following conditions:
<br />   				1.  The Board has determined that the applicant meets all the conditions of a Special
<br />       				Permit under Mass General Law 40A Section 9.

<br />      			All were in favor of the raze and replace project and pool.
<br />      			Mr. Bonvie made a motion that the existing shed that is 24 ft. from the wetland resource
<br />      			area which is pre-existing non-conforming, and the applicant does not need a Variance.He
<br />      			would like to accept a request by the applicant to withdraw his request of this Variance
<br />      			because there is no need for this Variance as instructed by the Building Inspector, Zoning
<br />      			Compliance Officer of this community.
<br />      			Mr. Kirrane made a request to withdraw the Variance request without prejudice. Mr.
<br />      			Bonvie made a motion to accept the applicant's withdrawal without prejudice in reference
<br />      			to the Variance application request for 424 Monomoscoy Road under Section 174-33
<br />      			setback to wetlands.
<br />      			Mr.Blaisdell seconded,yes,Mr. Gould,yes, Mr. Goldstein,yes,Mr. Bonvie,yes, and Mr.
<br />      			Furbush yes. All were in favor that the Variance request is not required.
