NO. 2472CV00026. <br /> Background <br /> • Lapse in approvals from 2015/2018 <br /> • Mr. Cayer appealed the denial of a large project proposal to the Superior Court <br /> • The case went before Judge Perino at Barnstable Superior Court in February <br /> • The judge took the matter under advisement without indicating a decision direction <br /> • Opposing counsel approached about a potential smaller project proposal <br /> • Property has a 4,000 sgft work limit with a proposed 2,256 sgft alteration of a naturally <br /> vegetated area <br /> • The entire property is land subject to coastal storm flowage <br /> • Property unable to maintain the required 75 ft naturally buffered vegetated strip <br /> Legal Implications <br /> • New buffer zone regulations unanimously passed May 1, 2023, town meeting <br /> 1 <br />
