Kirkland, <br /> Trustees of the Kirkland 2014 Family Trust request a Written Finding under§174-17 of the Zoning <br /> Bylaws to raze a single car garage,and replace it with a new two-car garage attached to an existing <br /> single-family dwelling on property located in an R-3, and Seabrook Village Cluster Subdivision, <br /> at 125 Surf Drive, Map 102, Parcel 1, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on October 11, 2024 and October 18, 2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, November <br /> 13, 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, <br /> Jonathan Furbush, and Scott Goldstein. Also present was David Morris, Building Commissioner. <br /> Attorney Christopher Kirrane represented Daniel G.Kirkland and Deborah A.Kirkland requesting <br /> a Written Finding to alter, extend, a pre-existing nonconforming structure. There were no <br /> comments submitted by the Conservation Department because the project is not in a flood zone. <br /> The proposal includes a front entry way and a two car garage that does not affect zoning. The <br /> property is located in the Seabrook Village Cluster Subdivision with the lot size of 15,000 sq. ft., <br /> frontage of 75 ft., a front yard setback of 30 ft., a side yard setback of 15 ft., a rear yard setback of <br /> 20 ft., and a 30%maximum lot coverage. <br /> There are two nonconformities with this project. The property fronts on two streets;on Sandy Way <br /> and Surf Drive. The front yard setback is nonconforming at 22.9 ft. and is nonconforming to the <br /> rear yard setback to Sandy Way at 17.8 ft. The current lot coverage is 14.1%,and the proposed lot <br /> coverage is 16.6% and well under the 30% allowed in the Seabrook Cluster. <br /> 1 <br />
