Town of Mashpee <br /> . , 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO <br /> EXISTING SPECIAL PERMIT (SP-86-04-024) <br /> SP-2024-61 <br /> Owner of Record: Mashpee Commons Bk.: 5221 <br /> Limited Partnership Pg.: 138 <br /> 38 Nathan Ellis Highway <br /> 14 Bank Street,Building 25 <br /> Map 74 Parcel 24 <br /> Mashpee, MA 02649 <br /> A Petition was filed on October 7, 2024 by Petitioner, Mashpee Commons Limited Partnership to <br /> request a Modification to an existing Special Permit(SP-86-04-024)to allow for re-purposing the <br /> use of an existing building located on property in the C-1 Zoning District, at 38 Nathan Ellis <br /> Highway,Building 25, 14 Bank Street, Map 74, Parcel 24, Mashpee,MA. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on October 11, 2024 and October 18, 2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, November <br /> 13, 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Acting Chair, Sharon Sangeleer, Board Members, William A. Blaisdell, Jonathan <br /> Furbush, Scott Goldstein and Associate Member, George Ganzenmuller. Also present was David <br /> Morris, Building Commissioner. <br /> Mr. Tom Feronti represented Mashpee Commons Limited Partnership seeking minor revisions to <br /> the existing Special Permit (SP-86-04-024) to address actual built conditions, certain square <br /> footage of commercial space and residential units, and actual built conditions of the parking <br /> facilities. <br /> The specific request relates to Building 25 located at 14 Bank Street in Mashpee Commons. The <br /> existing building consists of 2,950 sq. ft.,and was originally a bank with a drive-thru.The proposal <br /> consists of a change of use of that building to a food use with a drive thru. The square footage of <br /> the building will not change. The existing plan depicted the vehicle queuing on the east side of the <br /> building resulting in the drive-thru window being on the wrong side of the car in relation to the <br /> window of the building. <br /> 1 <br />
