* Introduction* <br /> I am appealing the decision for a special permit SP-2024-63. The properties at 17 and 20 <br /> Monomoscoy West Road also known as map 114-20 and map 114-75. A certified copy of this <br /> decision is attached as" Exhibit X. <br /> *Complaint* <br /> I, Michael Ciampi of 9 Pine Ridge Road map 114-76 abutt Monomoscoy West Road and the <br /> small unbuildable treed lot at 20 Monomoscoy West(map 114-75). The applicant owns a 2 <br /> bedroom house on Hamblin Pond with a standard gravity septic system on 17 Monomoscoy <br /> West Road. The proposed project is to tear down the existing house and build a 5 bedroom <br /> house but does not have enough room for a new septic system, mitigation plantings, <br /> driveway,etc.The engineers and designers have incorporated 4400 square feet of the 25' <br /> Monomoscoy West Road because expanding would be impossible on the 18000 square foot lot <br /> at#17. The applicant does not own the 25'road,or to the centerline, they have no title or deed <br /> for it,don't pay taxes on it,don't have an easement to put their private septic system across the <br /> road to#20,not a public utility,not contiguous ownership,can't block the road off to the Roberts <br /> family at map 114-74 or the town lot at map 114-73, and can't use the road for their front yard or <br /> driveway. Myself and most others have deeded rights to these 25'roads from a 1913 plan. i <br /> have proven that#1.7 only has specifically 10'of rights of ingress and egress and#20 the vacant <br /> unbuildable lot has no rights on their deeds. When I purchased my property 32 years ago I <br /> researched that I was abutting a vacant treed unbuildable lot,not someone's sewage plant being <br /> mechanically pumped uphill behind my house or not abutting someone's front yard when it <br /> should be a road. Many residents on Monomoscoy Island have encroached on the 25'roads <br /> and nobody is enforcing it,but to actually give a special permit to take over a road someone <br /> doesn't own is totally ridiculous. Also the small lot cannot have a structure on it. The engineer <br /> stated a leach field is not a structure.If the pipe,stone,and concrete leaching galleys are trucked <br /> in and installed how can this not be a structure?Also they are giving a 37'variance because <br /> there is a shed 3' off the road.Conservation Denied this project once last year being so close to <br /> salt water Hamblin Pond. <br /> I am asking the Land Court to annul and deny this special permit.The applicant has only owned <br /> the properties for 4 years and can't prove in black and white like I did,not everything just being <br /> implied.) am enclosing all written findingsl presented to the town (Exhibit B) and maps of the 25' <br /> Monomoscoy Wekt Rd from the Registry of Deeds showing a road is a road not a front yard or <br /> driveway(Exhibit C). <br /> Sincerely, Michael Ciampi <br /> f~ L a AWN GLERK <br />
