Clapper, 10 Sugar Pine Circle, <br /> Mashpee, MA, appealing the Building Commissioner's Decision under M.G.L. Chapter 40A §8 <br /> and §15 to issue a Certificate of Occupancy based on Condition #6 of the Zoning Board of <br /> Appeal's Decision(SP-2022-29)on property located in the I-1 and Light Industrial Districts, at 68 <br /> Mercantile Way,Map 88, Parcel 91, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on November 8, 2024 and November 15, 2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A§8 and §15 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, December <br /> 11, 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, William A. Blaisdell, Jonathan Furbush, <br /> Scott Goldstein, and Associate Member, Michael Milbury. Also present was David Morris, <br /> Building Commissioner. <br /> On Wednesday, July 27, 2022, a Special Permit (SP-2022-29) was issued and approved by the <br /> Zoning Board of Appeals under §174-24 (C) and §174-25 (G) (14) of the Zoning Bylaws for <br /> construction of a 9,972 sq. ft. Morton style building on a 143,346 sq. ft. lot. The building was <br /> constructed according to the plan set dated May 17, 2022 submitted by Baxter Nye Engineering <br /> and meets all the setbacks,parking, and landscape requirements and is conditioned in the Special <br /> Permit. The approved site plan depicts the building setback 55 ft. from the rear lot line, with a 10 <br /> ft. buffer situated within natural vegetation, and has a 75 ft. buffer that is owned by the Town of <br /> Mashpee. <br /> 1 <br />
