We are trying to figure out the timeline for the state, and modify this <br /> special permit to allow for a different entity to hold it. <br /> Mr. Tobin will confirm with the Assessors Office if placing that restriction on the land would <br /> decrease the value, making the taxes the same regardless of the entity holding the underlying <br /> fee, or if the homeowners could form a non-profit HOA, likewise receiving the same <br /> exemptions, if any, that the NLC would be entitled. <br /> PUBLIC COMMENT <br /> Sharon Muller- She inquired as to why the HOA was not taking this over. If not the <br /> homeowners, and it cannot be voted on for appearance, how will the tree trimming and natural <br /> state be cared for? <br /> Mr. Mills noted for the purposes of preservation, they thought it be better for the entity holding <br /> the property to be specifically designed for the preservation of land. HOA's are not in the <br /> business of preserving land. It will be maintained in its present conditions, with invasive species <br /> being eliminated, such as poison ivy. <br /> Mr. Milbury asked for examples of other pieces of land the conservancy owns around town to <br /> give peace of mind that they do an outstanding job. Ms. Waygan stated there was a letter in the <br /> packet from the Compact of Cape Cod Conservation Trust. <br /> Mr. Tobin asked for the Board's consensus about the NLC taking the land. <br /> Ms. Waygan stated they really care about the land preservation, and this restriction is the model <br /> the state uses for all this land that is bought or provided as open space. There was question <br /> about what the open space would look like or if walking trails were desirable among residents. <br /> Lynne Barbee- She lives in a cluster development, and her HOA controls the open space. <br /> They are not conservationists; there is however an arborist that lives there. The NLC <br /> understands how to maintain land and the residents will only benefit from that knowledge and it <br /> is a good size piece of land to be maintained. <br /> Ms. Waygan had questions about stormwater flow and the drainage easement. <br /> The HOA will be responsible for stormwater treatment upkeep. This site also came back as <br /> negative from the PAL study. <br /> Mr. Tobin stated the waiver requests aren't pertinent to this, in his understanding of the code, <br /> waivers aren't applicable. <br /> 3 <br />
