She asked for guidance from the agents on how to interpret the Wetlands Protection Act in this context. Mr. Dibb clarified that the 75-foot buffer does not extend onto the project site,noting the deck is 115 feet from the coastal bank and that no work lies within the 100-foot buffer regulated under the Wetlands Protection Act. Mr. McManus confirmed Mr. Dibb's assessment, explaining that the state's buffer zone extends 100 feet— not 150 feet—and that all proposed work occurs within an area already fully altered. No native vegetation would be disturbed; in fact, native plantings would be added within the flood zone. He said that any increase in roof runoff could be easily managed through dry wells or similar systems, given the project's small footprint. He concluded that the application was appropriately filed as an RDA. MOTION: For a negative determination at 18 Starboard Lane. Mr. Kent stated that an RDA can be conditioned as part of the regulations,it does not discourage it and it is on a case-by-case basis but with conditions of an RDA, you can do that and it can be added. AMENDED MOTION: To amend the Motion for a negative determination at 18 Starboard Lane with the conditions that one dry well go in. Proposed to get existing dock registered in the Town of Mashpee. (Jensen Corporation) Mr. Nelson Jenkins, president of Jensen Corporation and owner of 35 Santuit Lane presented a RDA to have the existing dock on his property officially registered with the Town. He explained that his intent was simply to ensure the dock was recognized so that he could replace deck boards in the future without issue. Mr. Larsson asked if there was a float and Mr. Jenkins acknowledged that the original drawing shows a float, but confirmed there is no float currently in place and that adding one in the future would require a Notice of Intent. He emphasized that no changes to the dock's structure or pylons were proposed.
