Unanimous. <br />Roll Call Vote: <br />Ms. Russell, yes Mr. Hyde, yes Ms. Waygan, yes Ms. Barbee, yes <br />Mrs. Wyman-Colombo, yes Ms. Godfrey, yes Mrs. MacDougall, yes <br />Mr. Schmuhl, yes Opposed, none <br /> <br />APPOINTMENTS & HEARINGS <br />Shirin Everett; Presentation by Town Counsel on Article 97: <br />The Community Preservation Committee (CPC) met with Town Counsel, Shirin Everett via <br />ZOOM to gain a better understanding of Article 97, an Act Preserving Open Space in the <br />Commonwealth. Article XLIX of the Amendments to the Constitution establishes a right to a <br />clean environment including its natural, scenic, historical, and aesthetic qualities for the citizens <br />of the Commonwealth. <br /> <br />Article 97 ensuring no net loss of open space, also declares the conservation of natural resources <br />a public purpose and provides that land or easements subject to Article 97 shall not be used for <br />other purposes or disposed of without a two-thirds roll call vote of the Legislature. <br /> <br />Ms. Everett indicated by its express terms, Article 97 applies to land “taken or acquired” for <br />conservation, development, and utilization of the agricultural, mineral, forest, water, air, and <br />other natural resources. Once acquired for an Article 97 purpose, the land is permanently <br />rd <br />protected for that particular purpose unless the General Court votes by a 2/3 vote of each house <br />to remove such protection. <br /> <br /> <br />
