MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES NOVEMBER 12, 2025 Mr. Morris has no issues with this project. Mr. Bonvie asked for a motion to close the hearing. Mr. Ganzenmuller, so moved. Mr. Blaisdell second. All were in favor. Mr. Reidy made a motion that the Board issue a Special Permit for the raze and replace project at 2 Bayview Road with the following conditions: 1. The Board has determined that the applicant meets all the conditions of a Special Permit under Mass General Law 40A Section 9. 2. Plot Plan—Prepared for: PJ Vande Rydt,Project: 2 Bayview Road,Date: August 20, 2025, Prepared by Cape & Islands Engineering, Stamped and signed by: Jacob Fricke, PLC, No.59305 and Mark Dibb, Civil Eng. No. 45937. 3. Building Plans: Proposed Residence for Vande Rydt Family, Date: 5/25, Drawing 1: Front Elevation, Right Elevation, #2.: Rear Elevation, Left Elevation, #3: First Floor Plan, #4: Second Floor Plan, Prepared by A.M. Michniewicz. 4. Conditioned on all Town Department comments read into the record including but not limited to the Board of Health and Conservation Department comments. 5. Any changes to the plans will require the applicant to return to this Board. 6. Conditioned that the applicant seek and obtain the Planning Department review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a building permit. 7. The Board finds under§174-17.1 that the proposed project as submitted is not substantially more detrimental to the neighborhood than the pre-existing conditions prior to removal of the existing structure, and that there is adequate land area on the subject lot to provide sufficient parking, and there are no new nonconformities being created.
