<br /> Public comment from Jessica Colpitts urges the BOH to vote to ban Kratom. She <br />does not feel this product should be in the Town of Mashpee or any town. <br /> Agent Seabury notes that Ms. Copitts is the only attendee from the public. Agent <br />Seabury invites any one from the public to call if they are interested in reading <br />the testimonials that were received by the Health Department. Agent Seabury <br />notes that the testimonials are not from any Mashpee residents. <br /> Mr. Ring thanks Ms. Colpitts for attending the public hearing and supporting the <br />board. <br /> <br />Public comments are closed. <br /> <br /> Board of Health deliberates the regulation. <br /> Mr. Ring motions to accept the Mashpee Board of Health Regulation Prohibiting <br />the Manufacture, Sale, and Distribution of Kratom. Mr. Livingston seconds the <br />motion. The board passes the ban unanimously (3-0). <br /> Agent Seabury suggest the regulation go into effect on January 21, 2026 which <br />gives time for retailers to receive letters to remove the product and submit the <br />regulation to the state for thirty day review. <br />Mr. Virgilio closes the public hearing. Reviewed and Approved Minutes – December 17, 2025. <br /> <br /> Mr. Livingston makes a motion to accept the minutes from December 17, 2025 <br />meeting as submitted. All in favor. Minutes approved. <br /> <br />NEW BUSINESS <br /> <br />1. Requirements for Board of Health Subdivision Review Hearing <br /> <br /> <br /> Agent Seabury has implemented a policy requiring any applicant for a <br />subdivision to undergo a peer review of definitive plans prior to submission to <br />the Board of Health. If the site is located within 150 feet of a wetland or <br />waterway, a Letter of Intent must also be submitted to the Conservation <br />Commission. Agent Seabury explained that future applications would only need <br />to be reviewed by the Board of Health and the Planning Board. The Conservation <br />Commission was added to the policy due to its jurisdiction over areas within 150 <br />feet of wetlands or waterways. <br />2 <br /> <br /> <br />
