The Title is very old and could not find express rights. The argument <br /> implied is the right of easement, but land court litigation rights to property takes <br /> a long time, and there is an urgent need in the Town for this project. <br /> The funding deadline for the Town to be awarded funding for this deadline is <br /> June 30th of this year, and one of the problems with the funding is the title to <br /> the project site and that includes access. It will be difficult certifying title by that <br /> deadline because it can now access a public way and can certify that access way <br /> as public. Litigation involving property rights is a lengthy process. <br /> Mr. Bonvie asked what type of traffic would be travelling down Gunter's Lane. <br /> Mr. Drainville said that it will be one pickup truck daily, and then a septic hauler <br /> once every one to two months based on the functions of other facilities. <br /> Mr. Furbush asked if the square items on the site plan will be moving closer to <br /> the lot lines. Mr. Drainville said they are in the same general area. Attorney <br /> Eichman said they are not any closer to any residences compared to the previous <br /> plan. <br /> Mr. Reidy asked if there would be any odor in that area. Mr. Drainville stated <br /> that there will be an odor control system in place, and the tanks are covered. <br /> Mr. Furbush asked if there would be any screening near Lot 19. Mr. Drainville <br /> said that area will be maintained by the existing natural grass buffer. <br /> Mr. Morizio asked if there would be any impact on private wells. Mr. Drainville <br /> said there will be no impact on upgradient wells. <br /> Mr. Bonvie asked if a model was performed for a MEPA permit. Mr. Drainville <br /> said yes. <br /> Mr. Reidy read the Board of Health comments into the record; "Variances for title <br /> 5 setbacks will be through board of health."Conservation Department comments; <br /> "Zero Gunther's Lane staff reviewed plans, and no work is proposed within the <br /> buffer zone to the vernal pool. No permit application is required at this time." <br /> The Board read letters into the record from residents; 32 Sturgis Lane, 5 Pierre <br /> Vernier Dr, 31 Gunters Lane, and 35 Ashumet Rd. <br /> 8 <br />
