MASHPEE ZONING BOARD OF APEALS <br /> Meeting Minutes <br /> February 11, 2026 <br /> Attorney Henchy said that this particular use under no circumstances under <br /> Section 174-24 that the Board is allowed to modify a Special Permit that reduces <br /> the amount of open space. <br /> Attorney Eichman responded stating that the there is no expansion of this <br /> subdivision. The application is for a modification to the existing Special Permit, <br /> and the criteria are contained in that section of the zoning bylaw. The Board's <br /> decision must be based on those criteria. The criteria relate to whether the open <br /> space can be reduced in a cluster subdivision. There's no mention in the cluster <br /> subdivision bylaw or in that section about whether the open space can be <br /> reduced for a particular use. Uses in the Town are governed by the zoning <br /> bylaws. If this area is taken out of the open space, the zoning bylaw will control <br /> how that property can be used. Yes, the Town intends to put a sewer treatment <br /> plant in there if that land is eliminated from or taken out of the open space <br /> requirement in the permit. The zoning bylaw allows for municipal use in this <br /> district. This is clearly a municipal use. The Building Inspector will determine if <br /> this parcel complies with the zoning bylaws. If there are environmental <br /> regulations, those will be made by boards with jurisdiction. This board is looking <br /> at the criteria for the Special Permit modification of a cluster subdivision. <br /> Mr. Bonvie stated that he would like to read the information mentioned by both <br /> Town Counsel and Attorney Henchy. <br /> Mr. Reidy would like to review the specific information to make an informed <br /> decision. <br /> Ms. Sangeleer mentioned she had voted against the proposal because the original <br /> plan had changes. <br /> Mr. Drainville stated that the plans are still in the design stages. <br /> Mr. Furbush asked Mr. Drainville if they could answer all the questions that <br /> were brought up by Attorney Henchy, and the letters that were read into the <br /> record. Attorney Eichman said yes. The material can be submitted to the Board. <br /> Mr. Blaisdell wanted the applicants to confirm what the exact application <br /> involves because it clearly states that your request is for a waste treatment plant. <br /> Mr. Drainville stated the request is for a reduction of open space. <br /> Mr. Bonvie would like to review the roadway design and asked that the applicant <br /> send him that information. He also noticed that the Board may want to continue <br /> the hearing. <br /> 10 <br />
