Article 29 <br /> <br />To see if the Town will vote to authorize the Select Board to grant to the Native Land Conservancy, <br />Inc. or other qualified entity, upon such terms and conditions as the Select Board deems appropriate, <br />a restriction for conservation, open space, and passive outdoor recreation purposes and allowing for <br />appropriate cultural access, upon the portion of Assessors’ Parcel 2-170 (0 Gunters Lane) reserved for <br />open space purposes as part of the Pimlico Heights cluster subdivision pursuant to Special Permit #SP- <br />87-05-053, as that permit has been and may be modified from time to time, provided in any event that <br />the land made subject to such restriction shall not include land removed from the open space <br />restrictions of the Special Permit, which land is anticipated to include the land consisting of <br />approximately 7 acres and more or less depicted as the site of a proposed wastewater management and <br />water quality treatment and disposal facility and access thereto on the plan entitled: “ZBA Site Plan <br />Figure 4, Sheet No. Figure 4, Client: Town of Mashpee, Massachusetts, Project: North Mashpee <br />Wakeby Pond Regional Satellite Facility, Project No. 12668217,” dated January 2026, prepared by <br />GHD, Inc. (the “Plan”), as such Plan may be amended from time to time, a copy of which has been <br />placed on file with the Town Clerk; and provided further that upon the granting of said restriction the <br />care, custody, management and control of the portion of Assessors’ Parcel 2-170 placed under a <br />conservation restriction shall be transferred from the care, custody, management and control of the <br />board or official then having custody and for such purposes as such land is then held to the care, <br />custody, management and control of the Town of Mashpee Conservation Commission under the <br />provisions of Massachusetts General Laws, Chapter 40, Section 8C, and subject to the protection of <br />Article 97 of the Amendments to the Massachusetts Constitution; and to authorize the Select Board to <br />enter into all agreements and take any and all actions as may be necessary or appropriate on behalf of <br />the Town to carry out the purposes of this article, or take any other action relative thereto. <br /> <br />Submitted by the Select Board <br /> <br />SEE VISUAL AID IN APPENDIX A <br /> <br />Explanation: This article would authorize the Select Board to place the remaining land not utilized in <br />the Mashpee Wakeby Cluster Treatment System under Article 97 of the Massachusetts Constitution <br />for the conservation of our natural resources and to negotiate with the Native Land Conservancy, Inc. <br />or other qualified entities for third party stewardship of the property allowing public and cultural access <br />rights to the public. Article 29 requires a 2/3 vote to pass. <br /> <br />The Select Board recommends approval of Article 29 by a vote of 5-0 <br />The Finance Committee recommends approval of Article 29 by a vote of 5-1 <br /> <br />Motion made by Select Board Member Richardson <br /> <br />Motion: I move the Town vote to approve Article 29 as printed in the warrant, with the exception <br />of the phrase “or take any other action relating thereto.” <br /> <br />Motion passes 199 to 90 at 9:14PM <br /> <br /> <br /> <br />
