<br />possession of fur products, nor does it apply fur used for religious, tribal, or cultural purposes, leather <br />goods or second-hand fur. <br /> <br />The Select Board recommends approval of Article 33 by a vote of 5-0 <br />The Finance Committee does not recommend approval of Article 33 by a vote of 6-0 <br /> <br />Motion made by Lead Petitioner Larry Ginsburg <br /> <br />Motion: I move the town to approve article 33 as written in the warrant, with exception to the <br />phrase “or take any other action relating thereto”. <br /> <br />Motion fails 115 to 133 at 9:38PM <br /> <br /> <br />Article 34 <br /> <br />To see if the Town will vote to amend Chapter 120, Section 120-2, Excessive Noise by Dogs, of the <br />General Bylaws of the Town of Mashpee by striking said Section 120-2 in its entirety and inserting in <br />place thereof the following: <br />§120-2 Excessive Noise by Dogs <br />History: <br />Added 5-5-2003 ATM, Article 29, approved by Attorney General 8-27-2003. <br />Amended 10-18-2004 ATM, Article 30, approved by Attorney General 1-27-2005. <br />Amended 10-20-2008 ATM, Article 19, approved by Attorney General 2-11-2009. <br />Amended 2026 ATM, Article ___, subject to Attorney General approval. <br /> <br />§120-2.1 Purpose <br />The purpose of this section is to protect the public health, safety, and welfare of the residents of the <br />Town of Mashpee by establishing reasonable and enforceable standards regulating excessive dog <br />barking and noise, while permitting responsible pet ownership and protecting residents ’reasonable <br />right to peace and privacy. <br />§120-2.2 Definitions <br />As used in this section, the following terms shall have the meanings indicated: <br />A. Dog – Any canine animal. <br />B. Owner and/or Keeper – Any person who owns, harbors, keeps, controls, or has custody of a dog. <br />C. Plainly Audible – Sound that can be clearly heard by a person with normal hearing faculties at a <br />distance of one hundred fifty (150) feet or more from the building, premises, vehicle, or conveyance <br />housing the dog. <br />§120-2.3 Excessive Noise by Dogs <br /> <br />
